1. Agency Agreement Terms

1.1 Introducing Agent Rights

When you contact us regarding any property, 21 Property Finder Ltd becomes your introducing agent for that property for a period of 90 days from the date of first viewing or detailed information provision.

1.2 Client Registration

We will register your interest with property owners, developers, investment companies, or their representatives to:

  • Facilitate property viewings and access to detailed information
  • Protect our commission rights as the introducing agent
  • Prevent duplicate registrations with other agents
  • Ensure smooth transaction process
  • Comply with Cyprus Real Estate Agents Law [71(I)/2010]

Legal Basis for Registration

This is standard practice in Cyprus real estate and is legally required. Under Cyprus law, only licensed real estate agents may receive commissions, and property owners/companies maintain records of which agent introduced which client to prevent commission disputes.

1.3 Commission Structure

  • Standard Rate: 5% of property value + 19% VAT
  • Payment: Commission is typically included in the property price and paid by the seller
  • Legal Entitlement: Only licensed agents (RN: 1022, LN: 505/Ε) are legally entitled to receive commissions under Law 71(I)/2010

1.4 Exclusivity

During the 90-day exclusivity period, you agree that:

  • 21 Property Finder Ltd is the sole agent for properties we have shown you
  • You will not contact the property owner/company directly to circumvent our commission
  • You will not engage another agent for the same property
  • Any transaction for properties we introduced will proceed through our agency

2. Data Protection & Privacy (GDPR)

2.1 Data We Collect

When you request property information or services, we collect:

  • Name and contact details (phone, email, address)
  • Property preferences and requirements
  • Financial information (if provided for property affordability assessment)
  • Communication history and viewing records

2.2 Legal Basis for Processing

We process your personal data based on:

  • Legitimate Interest (GDPR Article 6(1)(f)): To operate our real estate business and protect our commission rights
  • Contractual Necessity (GDPR Article 6(1)(b)): To provide the real estate services you requested
  • Legal Obligation (GDPR Article 6(1)(c)): To comply with Cyprus Real Estate Agents Law and anti-money laundering requirements

2.3 Data Sharing

We share your data with:

  • Property owners, developers, and investment companies (for viewings and transactions)
  • Legal advisors and conveyancing lawyers (when required for transactions)
  • Regulatory authorities (Cyprus Real Estate Registration Council, Data Protection Commissioner)
  • Financial institutions (for mortgage facilitation, if requested)

2.4 Data Retention

  • Active Clients: Until transaction completes + 7 years (legal requirement)
  • Inactive Clients: 2 years from last contact

2.5 Your Rights

You have the right to:

  • Access your personal data

  • Request deletion (subject to legal obligations)
  • Object to processing (subject to legitimate interests)

Important Note on GDPR Requests

While you have the right to request deletion of your data, please note that client registration with property owners/companies is a legitimate business necessity under Cyprus law. Requests to delete registration data may prevent us from providing services and may result in your inability to proceed with property transactions through our agency.

3. General Disclaimers

3.1 Property Information Accuracy

All property information is provided in good faith based on details supplied by property owners, sellers, developers, or their representatives. While we make every effort to ensure accuracy:

  • We do not guarantee the accuracy, completeness, or currency of property information
  • Property descriptions, measurements, and specifications may contain errors
  • Property photos may not reflect current condition
  • Prices are subject to change without notice
  • Availability is not guaranteed until contracts are exchanged
VERIFICATION REQUIRED: You must independently verify all property information with qualified professionals before making any purchase decision.

3.2 No Liability for Third-Party Information

21 Property Finder Ltd is not liable for:

  • Inaccurate information provided by property owners, sellers, or developers
  • Misleading property descriptions or specifications from third parties
  • Undisclosed property defects, liens, or encumbrances
  • Changes to property condition between viewings and completion
  • Planning permission issues or title deed problems

3.3 Professional Advice Requirement

We strongly recommend you obtain independent professional advice before purchasing property:

  • Legal Advisor: Independent lawyer for contract review and conveyancing
  • Surveyor: Property condition survey and valuation
  • Financial Advisor: Mortgage and investment advice
  • Tax Advisor: Tax implications and VAT assessment

Agent's Role

Real estate agents facilitate transactions but are not qualified to provide legal, financial, tax, or technical advice. We recommend property suitability based on your stated preferences, but final decisions are your responsibility after obtaining professional advice.

4. Client Responsibilities

Your Obligations

  • Provide accurate information about your requirements and financial position
  • Conduct independent due diligence on all properties
  • Obtain professional legal, financial, and technical advice
  • Verify all property information independently
  • Respect exclusivity agreements with our agency
  • Inform us immediately of any issues or concerns
